The National Association of Subrogation Professionals published Mark Demian’s article “Tricks, Tips, and Pitfalls to Recovering Underinsured Claims” in their Summer 2018 issue of Subrogator. This is Demian’s third piece featured in NASP’s subrogation education magazine. 

Recovering on underinsured cases is one of the most frustrating and daunting pursuits for subrogation professionals. There are certain steps to take and pitfalls to avoid to maximize the opportunities to recovery in subrogating underinsured claims and/or litigating against adverse carriers that Mark details in his article. 

Seeking Recovery from an Underinsured Motorist can be Tricky

Mark’s discussion lays out how and why identification and pursuit of an underinsured tortfeasor does have potential to result in subrogation recovery, pointing out that diligence and patience can go a long way in UIM subrogation claims. 

At the outset, subrogating counsel should try to work with the adverse carrier, as simply locating their insured may be just as much a problem for them as it is for you. Ask them to use their SIU department; you may find out the adverse carrier is cooperative, or you may discover that it is more convenient for them not to find their insured in the first place. 

Demian’s advice to subrogation professionals and attorneys includes how to maneuver Interpleader and Made Whole Doctrine pitfalls, as well as strategies for extracting information from an uninformed or uncooperative adverse carrier.
